My current company's CEO is retiring and the other partners are forming a new company. The current company will continue as a corporation and in the new corporation the current CEO will have 10% share. The new co will start with the current client base, employees, equipment, web site and use the current company's name as a DBA.
I am on H1-B visa with the current company and in the process for Permanent Residency with my I-140 approved and awaiting for the Priority Date to become current .
If the current company terminated me and i got re-hired with the new co.. what would i need to do for my H1-B visa and the Green card process. Please advice ASAP.

:mad:I have another query and thats is i have a a far related cousin and her husband is on l1 visa . now my query is what visa is she on and what visa is her daughter on who was born here few months bak . also how shud she apply for a passport for this kid . is this kid an american citizen and also how to go about passport for the kid and also is it required to apply for visa for the kid to travel to India . I need to re-file my I-485 application which was rejected due to USCIS error (they could not find I-140).
Can anybody tell me what is the logic behind writing "DO NOT OPEN IN THE MAIL ROOM" on envelope while re-submitting I-485 appplication?

Yes, she can come on H4 even she applied for I-485 , only if you are r still on H1B . If u or ur wife dont want to use EAD in near future then it is better to bring her on H4. otherwise coming back on H4 or AP does not make any difference.

I want to apply AP for my daughter without lawyer's help. I didn't apply for her when I applied my 485 and AP but her 485 has been applied and I have the RN. Is it straightforward process. Since I applied for 485 July 2nd can't file electronically and must use old fee?.
Also in the application instructions under intial evidence section it saysAn explanation or other evidence showing thecircumstances that warrant issuance of anadvance parole document; orWhat does this mean, do I have to write an explanation letter :confused:
AP is comparatively simple. You don't need to have a lawyer. Please go through all instructions carefully.
Yes you need to write a brief letter explaining why you need AP. You can say for family visit, family function ( if any ) etc.
I recommend applying online.

I had filed my 485 during the VB fiasco, but did not file for ead/ap, as my H1 was valid. I intend to apply now but not sure what the filing fee is? Can one of you guys who might have filed later guide me on what the fee amount is and the documents that need to go with it. Is Efiling an option?
USCIS website says $340 for the EAD and $304 for AP, but I guess it is the new fee and does not apply to folks who had their AOS filed before July 30, 07.

My PERM for EB3 has been approved on July 2008. My I-140 is pending. 485 has not been submitted yet. I don't have EAD card either. For some reason, I have to change job.
My question is, if my current employer will not revoke my current I-140 sponsorship, even I have left company, and in case my current I-140 will be approved, can my priority date be carried over?

During this span my company's attorney has unsuccessfully filed my I140 (twice was rejected at NSC and later TSC - due to 3 year degree and also my job description prior to transfer to US did not showed I have managerial/management function of a department). That is, I will have 120-plus "unemployment" days accumulated by early August, which will then violate the "90-day unemployment rule" of OPT.
I am under tremendous pressure and really want to hear your opinions.

ISO is the one which updates the SEVIS database. Since you claim its their mistake, you should approach them for advise on this as well. I have heard that voluntary work (no pay) in your field of study can help you to maintain your status and not count days towards the 90 day unemployment rule. You message is not clear. Are you saying he cannot work without getting a new H1. If he needs to get a new H1, then he needs to go out of the country for more than a year and come back later with a new H1.
I beleive, he can do H1 transfer. By the way, the new company should also start your labor and I140. Still you can port your PD if you have already 140 approved.

I spoke to my lawyer today and she made it very clear that it is ILLEGAL to file more than one I-485 for one applicant (from 2 diff companies). USCIS will immediately ask you to make a choice.
THought I should share this information
yes, thats because when filing I-485 you are 'promising' to join that company when you get your GC. How can you promise that to two companies at the same time.
However could you ask about being primary applicant on one petition and secondary on another (cases where both spouses are working, they can file two AOS and if either spouse decides to stop working for some reason the other application continues, the first can be withdrawn). This one is a grey area. Not illegal, but apparently at some point USCIS will ask you to pick one of the two. In this current mess where some companies/lawyers are promising to file, but may not do so in the end, better to give both choices a good shot, and hope atleast one gets through.

I opened Service requests and was told will get a new EAD for 2 years 3 different times and was told to wait for 45 days each time!!!
Finally it was time to apply for a new EAD and I hope to get one for 2 years this time around!

Hi,

Recently in dec i got my I-140 EB3 approved and my 485 is pending PD JAN 2005. I applied for EAD for my wife in july and she got it in sept. I am confused about what to do next?
