Hello,
I am working on H1-B for sometime. My project ended 2 months ago and I had been on unpaid leave since then. My H1-B expires on Sep 30, 2009. My company applied for H1-B extension in June but got a RFE due to lack of evidence. My company replied to the RFE on Aug 28. and status has been pending since then. On Sep 19, I got an offer from another company. The new company filed for premium processing for H1-B transfer and her transfer application got approved with starting date of September 24. I joined the new company on Sep 29 but haven't notified her old employer yet.
My immigration is underway and has got an approved I-140 from previous employer. That is the reason I didn't notify them as I don't want to stop that process. It is my intention to move back to her old employer if the visa extension is approved and the current project is finished so that I doesn't have to refile her Green card.
Now the question is what will happen in these scenario and purportedly 'Last Action rule' of USCIS:
1) If my Visa extension gets accepted, which VISA will hold good, the H1 ext with original employer or H1-B transferred visa with new employer ? Where should I report for work and is there anything legally I need to do before I reports to any of them ?
2) If my Visa extension gets rejected, will my transferred VISA still hold good ? Will I need to do anything in that scenario i.e. need to go out of country and get her Visa stamped ?

Besides, depending upon how the "CLASS" is defined- you will not lose your claim if they win the lawsuit.
It does not require you to have filed your case to benefit from the class action , but it depends on how the class has been defined. You can goto Rajiv's website and hear the latest conference call recording which explains his opinion on this.

The Kentucky Consular Center in Williamsburg, Kentucky has registered and notified the winners of the DV-2010 diversity lottery. The diversity lottery was conducted under the terms of section 203(c) of the Immigration and Nationality Act and makes available *50,000 permanent resident visas annually to persons from countries with low rates of immigration to the United States.
Winners should start finding out very soon. Notifications to the randomly-selected diversity visa or "green card lottery" winners are being sent between May and July 2010.
How does it all work?
Soon an official letter from the U.S. Department of State Kentucky Consular Center (KCC) in Williamsburg, Kentucky will be sent to the mailing address that you provided in your entry. Being selected as a lottery winner does not guarantee that you will receive a visa; you must still apply and qualify for the immigrant visa. US is a sovereign country and Govt of India cannot say what to do and how to handle the immigration issues. Hell GOI cannot handle its own immigration issue on the eastern border :)

It is a hard situation for me. I-485 interview for AOS is due in just 3-4 days from now. I am separated from my US citizen wife.Have not filed for divorce. I am employed in the US on a valid L1-B visa.
Our marriage may or may not work..
1. I need advice as to how to withdraw the I-485 AOS application. I do no have copy of documents/notices that USCIS sent.They are with my wife.
Or
2. If we do work out our differences then is there a way to keep the current AOS alive? Or shall I get the current one withdrawn and file for a new one if we do resolves our differences?
3. Also if I do withdraw the I-485 does it also mean that the I-130 filed by my wife is abandoned/revoked automoatically?
Really appreciate a prompt advice.

I believe it should be okay.
Make sure you get a copy of the advertisement and a copy of the link that it points to which has all the details. Make sure when you print it, it has the website link printed in the footer or header.

As per Spet 2009 visa bulletin, my PD will be current . I recently moved to LA due to Job change . If i do AC 21, do you think i will miss a oppurtunity of getting GC in spet since my PD is OCT 2004.
Please advise. Should i do AC21 now ? Or Should i do only on RFE?
Another question. I still have permanent address in chicago but moved to LA. Do i need to do AC11 form?

Looks like the long awaited spending bill is finally in the making and should make its way to the congress soon. For those of you who haven't contributed to IV, this should come as a warning that if you don't contribute now, it may just be too late for us to seek any relief in these bills.
Once this opportunity has passed, we'll be stuck with CIR which everyone knows is a tough pill to swallow for either party in the congress and could drag on for months and may never see the light of the day. So here are the choices:
1. Contribute now and try to get some relief from these spending bills.
2. Contribute later and try to get something done with CIR/SKIL.
3. Never contribute and just watch core members pull their hair trying to figure out why people are not contributing and just hope that GC will fall from sky.
Whatever you chose to do, please think twice before you make up your mind.

A startup in the area filed for my PERM and it was approved in June 2010. Right now, they are in a mess about their tax returns and reauditing with their CPA and it seems that they will not be able to provide tax statements for this year end.
That will cause the PERM to expire without filing I140 since PERM expires in Dec. Is there anyway for us to file extension for the PERM ? More than 180 days...

I am an American who has been a french man for the past 3 1/2 years. We met in college which he had a student visa to attend. Afterwards we moved together for him to get a job. At that time he still had a valid student visa and an OPT. We decided to move to France, but now after a year, I am ready to go home. We were PACSed (like a civil union) in France, but it is not valid in the states. I have read many things saying my boyfriend would need an H1B visa to work and stay. I have spent the past 2 days searching for companies that might sponsor him, which I have found none. He is a college graduate of East Tennessee State University, with a bachelor degree in business management. I have talked to people that all say to just get married but being 22 and 24 years old we want to wait and I don't want to say we got married for him to live in the states. My question is what are really his options? I would love to come back to the states ASAP but I want him there too. Are there lists of companies hiring and sponsoring H1B visas? Thank you so much for any help! It is very much appreciated!!

My client is trying to see if there are any possibilities to bring a graphic artist - flash developer from Phillipines, he currently works freelance and has made a big impression with his work. He has shown interest to come to US on h1b and company wants to know if they have any issues in bringing him onboard by sponsering a h1b. The issue is, he does not have college education, other than that, he qualifies excellent for a job in this company. Will he have issues in getting a h1b? Has anyone got H1b visas with college degrees but only with work experience?

I came in US with my family when I was 15-16, back then we were on L2, then as time passed by we switched to H4. Then I turned 21 so I had to go on Student Visa (F1). Still living in US legally.
Now my question is I've been staying in US over 10 years now, legally. I dont know if its rumor or not, but someone told me, that you can apply for Green Card if you lived in US over 10 years legally, is that true?
Going through all that H1B process sounds really hectic. Also all my family members, friends and relatives are here, I don't know anyone back in my birthplace. any suggestions or tips, would help a bit.
